Idaho’s Six-Week Abortion Ban Tested by Planned Parenthood (1)

A new Idaho law prohibiting abortions after cardiac activity is detected, which happens at about six weeks’ gestation, violates the state constitution, a Planned Parenthood affiliate said in a new lawsuit filedWednesday.

The law is a “copycat Texas-style abortion ban,” according to Planned Parenthood Great Northwest, Hawaii, Alaska, Indiana, Kentucky’s petition for Idaho Supreme Court review. Like Texas’s S.B. 8, it expressly prohibits state officials from taking any enforcement action—a provision that tripped up abortion providers challenging the Texas law.
