An Idaho environmental organization adequately followed federal procedure to sue a cow feedlot owner that it alleges is improperly managing its manure supply, a district court ruled.
Feedlot owner and operator J.R. Simplot Co.'s contentions that Snake River Waterkeeper lacked subject matter jurisdiction and didn’t state a claim failed, said Judge David C. Nye of the US District Court for the District of Idaho, denying Simplot’s motion to dismiss. “Simplot’s jurisdictional challenge neither contests the truth of SRW’s allegations, nor relies on matters outside of the pleadings,” Nye said in his memorandum decision and order.
