Idaho is appealing a federal court decision that precludes it from enforcing a total abortion ban in a way that’s inconsistent with a federal emergency care law.
The state filed a notice of appeal Wednesday indicating that it’s taking the case to the US Court of Appeals for the Ninth Circuit.
Judge B. Lynn Winmill, of the US District Court for the District of Idaho, partially blocked the ban in August 2022 to the extent it conflicts with the Emergency Medical Treatment and Labor Act. He denied a motion for reconsideration May 4.
