Idaho Unable to Use Immigration Status to Deny HIV Benefits (1)

A federal judge extended a block on an Idaho law that uses an applicant’s immigration status to determine whether they’re entitled to HIV benefits from a federally funded program.

“Plaintiffs have raised serious questions on the merits of their preemption claim and established the likelihood of irreparable harm,” said Judge Amanda K. Brailsford in an opinion for the US District Court for the District of Idaho. “Further, the balance of equities and hardships favor preserving the status quo,” Brailsford said, extending the block by granting a preliminary injunction. She also approved the certification of a provisional class.
