ID Verifier Must Face OfferUp Customer’s Privacy Suit in Court

Onfido Inc. must face in court a proposed class action brought against it by an OfferUp Inc. customer over alleged privacy violations, after an Illinois federal judge on Tuesday found the identity-verification partner unable to use the online marketplace’s arbitration clause.

Fredy Sosa alleges violations of the Illinois Biometric Information Privacy Act against Onfido, saying it collected and stored biometric information from users without their permission in the course of its partnership with OfferUp for identity verification services.

Onfido removed the action from state to federal court in July 2020, and then sought to compel arbitration based on OfferUp’s terms ...
