ICE Detainee Gets Court to Certify Classes for Due Process Claim

A detained non-citizen convinced a federal court to partially certify two classes in his challenge to the Tacoma Immigration Court’s practice of mandating detention without the possibility of bond for noncitizens who entered the US without inspection.

Ramon Rodriguez Vazquez showed that the classes should be certified to allege that the Tacoma Immigration Court is violating the Fifth Amendment’s due process clause for delayed adjudication of bond appeals, Judge Tiffany M. Cartwright of the US District Court for the Western District of Washington said in a May 2 order partially granting a motion for class certification.
