Ice Cream Manufacturer Sued After Recalling Dozens of Products

Totally Cool Inc. was hit with a proposed consumer class action alleging it deceptively marketed products as safe after voluntarily recalling more than 60 items earlier this week because of the risk of bacterial contamination.

The Maryland-based food manufacturer’s advertising and marketing is deceptive because the packaging does not disclose that the ice cream products risk containing Listeria monocytogenes, the bacteria that led to the recall, the complaint filed Wednesday in the US District Court for the Southern District of New York said.

The affected items include products from Friendly’s, Hershey’s, Jeni’s, Dolcezza Gelato, and others.
