ICE Agent Cleared in Shooting of Fleeing Man, Appeals Court Says

An Immigration and Customs Enforcement agent isn’t liable for damages for shooting a fleeing unarmed man since the officer was acting under the color of federal authority, a split federal appeals court ruled Monday.

Gabino Ramos Hernandez failed to allege that ICE agent Phillip Causey acted under the color of state authority or conspired with local police officers when the agent shot him, a majority with the US Court of Appeals for the Fifth Circuit said in an opinion. The dismissal of Hernandez’s Civil Rights Act lawsuit against Causey was affirmed by the majority.
