IBM Loses Bid to Stop Sales Specialist’s Unjust Enrichment Claim

A former IBM sales specialist can continue to allege that the company unfairly denied him nearly $1 million by capping his sales commissions, a California federal district court said.

IBM failed to show that Pavel Guarnernos Rodriguez’s unjust enrichment claim is barred by the applicable three-year statute of limitations under California law, Judge Beth Labson Freeman, of the US District Court for the Northern District of California, said in a Monday order denying a partial motion to dismiss.
