Switching babies at birth and sending them home with the wrong families counts as a health care liability claim under Texas law, a state appeals court ruled Thursday.
Christus Spohn Health System Corp. had a duty to create and maintain accurate medical records, and their failure to do so here led to the misidentification of two baby girls more than 50 years ago, the Texas Court of Appeals, Thirteenth District said, reversing the trial court’s denial of the hospital’s motion to dismiss.
The trial court initially concluded the case didn’t fall under a health care liability claim.
