Honda’s Win Upheld in Civic Air Conditioning Class Action Suit

American Honda Motor Co. won’t face revived class action claims that flaws in its 2016–2018 Honda Civics caused the air conditioning system to fail.

The plaintiffs, 21 consumers who purchased Civics from various dealerships, said the trial court erred in dismissing their fraud, consumer protection, and breach of implied warranty of merchantability claims.

“The vast majority of consumer complaints were made after Appellants purchased the Class Vehicles, and the remaining complaints are too few in number to suggest Honda had knowledge of the defect,” the US Court of Appeals for the Ninth Circuit said.
