Home Depot U.S.A. Inc. defeated part of a retail worker’s wage-and-hour suit after a federal judge in California determined one claim insufficient to move forward.
The home improvement chain successfully argued that the worker’s claim for restitution of withheld wages under a state unfair competition law is doomed because it’s based on the same alleged facts as one of her other wage claims, so she doesn’t lack an adequate legal remedy, the US District Court for the Eastern District of California said.
