Home Depot Defeats Class Lawsuit Over $9 Billion 401(k) Plan

Home Depot Inc. defeated a class action challenging the fees and investment funds in its $9 billion 401(k) plan when a Georgia federal judge ruled that the company’s management of the plan, if potentially imperfect, didn’t cause any losses.

The evidence is “inconclusive” as to whether Home Depot fulfilled its fiduciary duties in monitoring the plan’s service fees and certain investment options, but it’s clear the plan didn’t suffer losses stemming from any potential mismanagement, Judge Steven D. Grimberg said in a lengthy Sept. 30 opinion granting summary judgment to the retailer.
