Home City Ice Settlement Gets Final Nod in Underweight Bags Suit

Home City Ice Company will change how it sells seven-pound bags of ice after a judge gave his final approval to a class action settlement.

The nationwide class was certified by Judge Timothy S. Black for injunctive relief over allegations HCI knowingly sold bags marketed and mislabeled as weighing seven pounds. But Black declined to certify the class for monetary relief in part because consumers likely wouldn’t know at the point of purchase the bag would be underweight. The settlement in the Southern District of Ohio requires HCI to increase the acceptable fill minimum for seven-pound ice bags to 7.1 ...
