Home City Ice Buyers Win Class Status in Underweight Bags Suit

Consumers alleging Home City Ice Co. sold underweight bags of ice won class status for injunctive relief such as marketing changes, but a federal court in Ohio declined to certify a class for money damages in part because ice melts so fast.

Indiana resident Rick Pansiera alleges that about 14.3% of HCI’s “7lb” bags weigh less than seven pounds, causing him and others to overpay. He raised various common law and consumer protection law claims on behalf of others nationwide who bought underweight bags.
