Three home-care firms can try again to invalidate a Labor Department wage exemption rule revision after an appellate panel Friday evaluated the suit’s timeliness in light of a new high court opinion.
A June US Supreme Court decision allowing new businesses to challenge old regulations “explicitly overruled” the reasoning behind the district judge’s dismissal of the firms’ case, the US Court of Appeals for the Third Circuit said. The limitations period can still kick in at different times depending on how an entity attacks an agency rule, but these firms sued within the relevant period, the unpublished opinion said. ...
