Holland Acquisitions Inc.'s former CEO is headed to trial in a US Department of Labor lawsuit accusing the executive of misclassifying employees to avoid properly compensating them, a federal court said.
Questions of fact still exist on the workers’ status as employees or contractors, the chief executive officer’s employer status under the Fair Labor Standards Act, and if he acted willfully, Chief Judge Mark R. Hornak of the US District Court for the Western District of Pennsylvania said Tuesday.
