Pennsylvania-based health insurer Highmark Inc. must face several claims of a proposed class action alleging it negligently failed to protect consumers’ personal information that was exposed in a 2022 data breach.
The plaintiffs alleged concrete injuries that were sufficient for standing, and adequately pleaded claims of negligence, breach of implied contract, unjust enrichment, and declaratory judgment, Judge J. Nicholas Ranjan of the US District Court for the Western District of Pennsylvania said Monday.
