Hershey Beats Suit Claiming Heavy Metal in Lily’s Chocolate Bars

A Lily’s Chocolate customer alleging Hershey’s deceptively marketed the unit’s 70% dark chocolate bar by failing to disclose the presence of lead and cadmium lacked standing to sue the company, a federal court said Wednesday.

Annalisa Kell based her proposed class allegations on a 2022 Consumer Reports article that reported the presence of lead and cadmium in chocolate bars from 21 different brands. But she didn’t show the products she bought contained the heavy metals and therefore failed to plead an injury, the US District Court for the Southern District of New York said.
