Hemp Businesses Fail to Revive Suit Targeting Wyoming Crackdown

A group of hemp distributors couldn’t convince a federal appeals court Monday that their lawsuit challenging Wyoming’s stringent hemp regulations was wrongfully dismissed.

The businesses failed to state a cognizable preemption claim, failed to demonstrate a constitutional violation, and haven’t established a regulatory taking of their commercial personal property, Judge Harris L. Hartz wrote for the US Court of Appeals for the Tenth Circuit, affirming a lower court’s dismissal.
