A California beer company didn’t file its trademark infringement lawsuit over its Cuban-inspired alcoholic beverage’s mark in the correct venue, a federal judge said.
Soltura LLC didn’t meet its burden to show that California was the proper venue to bring its federal trademark and trade dress infringement claims, as well as its associated unfair competition claims under state law, against Florida-based Cerveceria La Tropical USA LLC, Judge James E. Simmons wrote in an opinion for the US District Court for the Southern District of California on Oct. 20.
