Chinese tech company Nations Technologies (USA) Inc. and affiliated defendants in a civil racketeering lawsuit can pursue a subset of counterclaims against hedge fund CEO Xuefeng “Eric” Dai, a New York federal court said.
The US District Court for the Southern District of New York said counterclaims for defamation based on statements made by Dai to law enforcement after April 7, 2021 could proceed. However, Judge Edgardo Ramos dismissed Nations’ counterclaims for breach of contract, fraud, breach of fiduciary duty, unjust enrichment, conversion, and tortious interference.
