Hearst’s Copyright ‘Discovery Rule’ Challenge Rebuffed by Court

The US Supreme Court declined to review whether the “discovery rule” applies to belated copyright claims against Hearst Newspapers LLC, just days after the justices found in another case that damages would be available if it did.

Hearst’s petition in the dispute over photographer Antonio Martinelli’s images challenged the rule, which lets copyright plaintiffs sue outside of a three-year statute of limitations if they couldn’t have discovered, the infringement in time.
