Harbinger’s Fraud Case Against Apollo Gets Wary Court Reception

A panel of New York judges were skeptical of Harbinger Capital Partners II LP’s arguments Thursday that it didn’t act too late in suing Apollo Global Management LLC for fraud as part of a $2 billion telecommunications deal.

Harbinger argues it wasn’t on notice of the fraud until 2015, but judges of the New York Supreme Court First Appellate Department noted that several other actions occurred starting in 2010 that signaled something was wrong with the network.

“It’s like being at the UN—weren’t the flags flapping saying something is going on here?” asked Associate Justice Lizbeth González.
