Handi-Foil Corp. convinced a federal judge that a consumer alleging the company deceptively advertised its aluminum pans as “Made in the USA” couldn’t show an injury.
The US District Court for the Eastern District of New York said the consumer didn’t show she paid a price premium for the pans, and granted Handi-Foil summary judgment on the claims Wednesday. The order was filed Thursday.
Merryl Osdoby, in a proposed class action, alleged Handi-Foil labeled its retail aluminum pans as “Made in the USA” despite using raw materials that were mined or processed outside of the United States.
