Gun Ownership Bar Over Decades-Old DUI Debated Before 3rd Cir.

A panel of Third Circuit judges on Monday questioned whether a man challenging the constitutionality of a federal law barring him from owning guns over a 20-year-old drunk driving conviction must first go through a new relief process being set up by the government.

Chief Judge Michael A. Chagares pressed the government’s counsel on whether the procedure, which has yet to be finalized, is a required administrative process that Edward Williams must go through before bringing his challenge in court. “This is something relatively new,” Chagares said, questioning if it matters that there’s “no real rule in place.”
