Gun Group’s Michigan Background Check Lawsuit Deemed Moot (1)

A Second Amendment-focused group’s lawsuit against the federal government over its determination that Michigan concealed-carry permit holders must undergo federal background checks to buy new guns must be tossed for mootness, the Sixth Circuit said Thursday.

The case “has become stale” because the Bureau of Alcohol, Tobacco, Firearms, and Explosives in May rescinded an advisory from President Donald Trump’s first term that said Michigan firearms dealers must conduct FBI background checks for all prospective buyers, regardless of whether that person has a state permit, US Court of Appeals for the Sixth Circuit Chief Judge Jeffrey S. Sutton said.
