Gulfstream Arbitration Agreement Blessed by Massachusetts Court

Gulfstream Aerospace Services Corp.'s agreement requiring employees to arbitrate their disputes is enforceable because it puts the signer on reasonable notice of its terms and obtains their assent, the Massachusetts Appeals Court held Wednesday.

“The plaintiff was not only ‘encouraged’ to review the terms but could not advance to the next stage of his onboarding process without checking the box” next to the dispute resolution policy, “rendering his electronic signature at the bottom of the page, and checking a separate box that stated, ‘I agree,’” the opinion said.
