Guam’s 1990 Total Abortion Ban Remains Blocked, Court Says

Guam can’t enforce a total abortion ban that was blocked in 1990 under then-current law recognizing a right to abortion under the US Constitution.

The US District Court for the District of Guam rejected Attorney General Douglas Moylan’s (R) request to vacate a federal court’s permanent injunction barring Guam from enforcing a law that had criminalized essentially all abortions in the territory.

Moylan didn’t meet his burden of showing that the US Supreme Court’s opinion in Dobbs v. Jackson Women’s Health Organization warranted lifting the permanent injunction in its entirety, Chief Judge Frances M. Tydingco-Gatewood said in Friday’s brief opinion. ...
