The Justice Department’s decision to stop funding legal aid for the mentally incompetent at immigration proceedings is illegal, advocates allege in a federal lawsuit.
The US Department of Justice’s rollback of its National Qualified Representative Program violates the Administrative Procedure Act, the Immigration and Nationality Act, and the Rehabilitation Act, advocates said in their complaint Monday. They also alleged the move violates the Fifth Amendment as well as the doctrine established under Accardi v. Shaughnessy, which requires agencies to adhere to their own regulations, policies, and procedures.
