GOP-Led States Sue to Stop California Plastic Packaging Law (1)

Seventeen US states sued California Monday claiming the state’s plastic packaging law violates the Commerce Clause and other constitutional protections by imposing nationwide regulations.

The states, each of which has a Republican attorney general, are suing to void California’s Plastic Pollution Prevention and Packaging Producer Responsibility Act.

The law, which was passed in 2022, will require packaging to be recyclable or compostable by 2032.

“The Act offends State sovereignty,” the states’ filing said. “California is not entitled to pronounce nationwide policies; it has no power to ‘project its legislation’ into other states as if it were first among equals.”
