Google Keeps Texas License Company’s Patent Suit in California

Motion Offense LLC will have to defend its patent infringement suit against Google LLC in a California federal court, after it lost its bid to keep the case in Texas.

The US District Court for the Western District of Texas rejected the patent license company’s request to reconsider its order granting transfer in light of a 2022 US Circuit Court for the Fifth Circuit opinion about the case law that governs transfer motions. Instead, Judge Alan D. Albright relied on a Federal Circuit opinion related to another Google case to hold that Motion Offense’s reconsideration request should be denied.
