Google Chrome Users Seeking Privacy Damages Intervened Too Late

Users for Google LLC‘s Chrome browser were too late in their attempt to intervene in a privacy class action settlement agreement involving the browser’s Incognito mode, a federal appeals court ruled Monday.

The intervening users objected to the settlement agreement’s terms that would prevent the class from filing an appeal of a trial court order that prevented the class from seeking damages from Google.

“This case presents an example of ‘too little, too late’ for would-be class action intervenors,” Judge Kenneth Lee wrote for a three-judge panel for the US Court of Appeals for the Ninth Circuit.
