Good Belly probiotic juice maker NextFoods Inc. and consumers who alleged it deceptively portrayed a high-sugar drink as healthful got a federal judge’s initial approval for a $1.25 million class settlement.
Evlyn Andrade-Heymsfield sued in the US District Court for the Southern District of California, challenging label phrases such as: “Reboot your belly, then make GoodBelly your daily drink to keep your GoodHealth going. Because when your belly smiles the rest of you does too.”
The healthful portrayal is misleading because the sugar in the drinks increases the risk of diabetes, heart disease, and other problems, she alleged.
