Godaddy’s $35 Million Junk Fax Deal Tossed by Eleventh Circuit

A proposed $35 million settlement of a class action alleging Godaddy.com LLC sent marketing texts in violation of the Telephone Consumer Protection Act was thrown out Monday by a federal appeals court.

The lower court abused its discretion in approving the deal, overlooking evidence of collusion between class counsel and the Godaddy.com attorneys, failing to ensure absent class members were informed about a case before the US Supreme Court likely to decide the central issue in their case, and improperly calculating attorneys’ fees after concluding the deal wasn’t a coupon settlement, the US Court of Appeals for the Eleventh Circuit ...
