GM Convinces 6th Cir. to Rehear Class Certification Challenge

A federal appeals court on Thursday said it would rehear a challenge over whether a district court improperly certified dozens of state sub-classes in a lawsuit alleging General Motors Inc. made vehicles with faulty transmissions.

A majority of judges on the US Court of Appeals for the Sixth Circuit voted for an en banc rehearing and vacated a judgment affirming certification of 26 state sub-classes in the lawsuit. GM told the court that absent such review, the earlier opinion would “transform the Sixth Circuit into a national outlier and magnet for class-action lawsuits.”
