GM Transmission Case Classes Decertified by En Banc Court (1)

General Motors LLC prevailed Friday in its bid to decertify more than two dozen state-wide classes in litigation over allegedly faulty transmissions.

“Because the subclasses do not meet the rigorous requirements for handling all of these cases in one district court, whether as one case or 26 cases, we vacate the class-certification order,” Chief Judge Jeffrey S. Sutton wrote for the majority of an en banc US Court of Appeals for the Sixth Circuit panel.

The classes would have included approximately 800,000 people in the case alleging the GM transmissions caused cars to shudder and lurch unexpectedly.
