GM Beats Appeal in Suit Over Alleged Dashboard Defects

General Motors LLC is entitled to dismissal of a fraud-based class suit alleging some of its popular trucks and sport-utility vehicles have dangerous crack-prone dashboards, because the plaintiffs failed to allege facts showing the automaker knew of the alleged flaw at the time of sale, the Sixth Circuit said Thursday.

James Smith and others alleged their vehicles developed dashboard cracks years after purchase that could cause severe injuries because malfunctioning airbags could turn the plastic dashboards into deadly projectiles during a crash.

Affected vehicles include 2007 to 2014 Chevrolet Silverado, GMC Sierra, Chevrolet Tahoe, and Cadillac Escalade, models.
