Glanbia Avoids Consumer Class Action Over Label on Protein Bars

Glanbia Performance Nutrition Inc. doesn’t have to face a nationwide class action under Illinois law accusing the company of using a misleading label on its think!® High Protein bars, a federal court said.

The Illinois Consumer Fraud and Deceptive Practices Act doesn’t apply outside of the state, the opinion by Judge Jorge L. Alonso said for the US District Court for Northern District of Illinois on Thursday, denying nationwide class certification on that issue.

Plaintiff John Daly said that he bought the bars based on a statement on the front of the box that the bars have “NO ARTIFICIAL SWEETENERS.” ...
