Givaudan Fails to Get Popcorn Worker’s Lung Injury Suit Tossed

Givaudan Flavors Corp. and others could face trial in a former popcorn plant worker’s suit alleging the butter flavoring diacetyl caused him lung injuries, after an Iowa federal court’s ruling that a jury must decide if he sued within the state’s two-year time limit.

Jason Thiele raised fact questions concerning when he knew or should have known his respiratory problems were caused by workplace exposure to the flavoring, putting him on notice of a claim, the U.S. District Court for the Northern District of Iowa said Wednesday.
