Gilead, Michigan Hospital Win Appeal Over Tainted Covid-19 Drug

A lawsuit filed by the loved ones of a man who suffered two strokes after being treated with a medication for Covid-19 that allegedly contained glass particles must fail because federal law doesn’t allow it, the Michigan Court of Appeals ruled.

The claims against Gilead Sciences Inc. and St. Joseph Mercy Chelsea hospital must be dismissed due to the federal Public Readiness and Preparedness Act, a three-judge panel said Tuesday. The 2005 law encourages quick development of medications during public-health emergencies by allowing the secretary of Health and Human Services to limit who can be sued for administering medical countermeasures. ...
