A Georgia tax on strip clubs violates the First Amendment, a free speech advocacy group told the US Supreme Court Tuesday.
The tax “specifically targets establishments based on expressive performances, the content of which must be evaluated to determine the applicability of the tax,” the Foundation for Individual Rights and Expression said in an amicus brief. Content-based laws are forbidden under the constitution to prevent government overreach, FIRE said. It was joined by the First Amendment Lawyers Association.
