General Motors Worker’s Race, Sex Bias Claims Revived on Appeal

A Black General Motors LLC worker who says the company engaged in race- and sex-based discrimination against her presented enough evidence for her claims to reach a jury, the Second Circuit said Thursday.

The worker put forth proof that she faced sexist comments and that a manager at the New York plant where she worked called her “dumb,” in front of other GM employees, augmenting the remark with a racial slur, so the district court shouldn’t have granted summary judgment to the automaker on her bias claims, the US Court of Appeals for the Second Circuit ruled.
