A federal judge properly dismissed wiretapping claims against Gen Digital LLC based on the software company’s collection of data from users of its browser extension designed to prevent surreptitious data collection, the Ninth Circuit said.
Lead plaintiffs Grace Lau and Christopher Karwowski failed to show that the software company was a third party to their communications, a requirement for liability under the federal Electronic Communications Privacy Act and the California Invasion of Privacy Act, the US Court of Appeals for the Ninth Circuit said Monday in an unpublished, unsigned opinion.
