Gemini Motor Transport LP must face a proposed class action alleging it collected the face scans of truckers without their consent in violation of the Illinois Biometric Information Privacy Act.
Lead plaintiff Nathaniel Timmons adequately alleged that Gemini obtained his biometric information in violation of the BIPA, and that the information at issue was covered by the Act, Judge Edmond E. Chang of the US District Court for the Northern District of Illinois said March 28.
Timmons’ claims also weren’t preempted at the pleading stage by federal transportation-safety laws and regulations, Chang said in denying Gemini’s motion to dismiss.
