GEICO Workers in Unpaid Overtime Class Fail Certification Bid

A group of GEICO claims investigators failed to get class certification in their lawsuit claiming overtime wage violations to New York labor law.

The proposed class couldn’t meet predominance requirements under Federal Rule of Civil Procedure 23 because they presented factual inconsistencies in time they worked and how their supervisors responded to requests for overtime, the US District Court for the Eastern District of New York said in a Feb. 20 order.
