Gamestop Beats Wiretap Suit Over ‘Session Replay’ Software

GameStop Corp. defeated a proposed class action alleging it used website tracking software to record visitors’ interactions with its site in violation of Pennsylvania’s wiretap and privacy laws.

Amber Cook failed to establish that she suffered a concrete injury through GameStop’s alleged practices, a threshold requirement for standing to bring a lawsuit in federal court, Judge J. Nicholas Ranjan of the US District Court for the Western District of Pennsylvania said Monday.

Cook also failed to plead facts to support her claims of invasion of privacy and violation of the Pennsylvania Wiretapping and Electronic Surveillance Control Act, Ranjan said.
