Gamblers Dismiss Suit Over Kentucky Derby Payout, for Now

A proposed class action by bettors who say they would have won their wagers on the Kentucky Derby but for Medina Spirit being incorrectly named first-place finisher was voluntarily dismissed.

Counsel for the plaintiffs, William D. Nefzger with Bahe Cook Cantley & Nefzger PLC, said the case was dismissed for procedural reasons but will be refiled “in the near future.”

“My clients and I both continue to strongly believe in the merits of the case,” Nefzger told Bloomberg Law Sept. 2.
