A $10 million judgment against New England retail chain Jordan’s Furniture for improperly paying commission workers overtime and Sunday pay is sparking a battle over when the Massachusetts Supreme Judicial Court’s rulings can be applied retroactively.
A Massachusetts Superior Court judge in 2021 found that the furniture and mattress retailer violated Massachusetts Wage Act requirements established in Sullivan v. Sleepy’s in 2019, even though Jordan’s payment plan was implemented before the Sleepy’s ruling. The Supreme Judicial Court will hear oral arguments Wednesday in Jordan’s appeal.
