FTC’s Khan Preaches Strength After Supreme Court’s Chevron Flip

Federal Trade Commission Chair Lina Khan told a group of judges on Wednesday that the agency’s still empowered to set competition rules despite a recent US Supreme Court ruling overturning the Chevron doctrine, which gave federal agencies leeway to interpret law.

“As a general matter, the FTC has not relied on Chevron deference as much as agencies” like the Federal Communications Commission or the Environmental Protection Agency, Khan said at this year’s judicial conference for the US Court of Appeals for the Ninth Circuit in Sacramento. “I think the immediate impact may be more limited.”
